REFUNDS/ RETURNS/ CANCELLATIONS

All website purchases are considered to be final.  Exceptions will be made for processing errors.  All refunds for processing errors will be refunded to the credit card used for the purchase.

FACULTY/STAFF MEAL PLAN AGREEMENT
This agreement is made between ARAMARK and the Faculty/Staff meal plan participants, who agree to the following:
1. Cancellation Policy. All Faculty/Staff meal plan purchases are final.
2. Faculty/Staff meal plan participants must submit payment in full at time of sign-up with a Faculty/Staff meal plan, unless participating in our EZ Pay Plan.
*A $25 administrative fee will be charged for any disputed credit card charges.
3. Your UTSACard serves as your Faculty/Staff meal card and is required for all transactions — no exceptions.
4. Faculty/Staff meal plans are not transferable to others. Faculty/Staff meal plan participants may bring in guests by using their Faculty/Staff meal plan.
4. Dining Dollars associated with a Faculty/Staff meal plan do not expire.  After one consecutive year of non-activity, all remaining Dining Dollars will be forfeited.
9. ARAMARK reserves the right to alter services or hours of operation. Notice will be given with modified schedules posted in all dining locations and online. Retail locations may be open prior to residence hall opening dates.
By placing an order, you agree that you have read and understand these Terms and Conditions and are bound by all of them, as they may be changed from time to time, and you consent to ARAMARK's collection and use of your personal information in accordance with ARAMARK's Privacy Policy.

EZ PAY PLAN POLICY
EZ Pay Plans require an initial purchase of a Faculty/Staff meal plan to sign up and two (2) payment installments per the Faculty/Staff meal plan you have selected to purchase.  The credit card used for the purchase of the EZ Pay Plan on the website will be charged twice; half payment on the date of purchase and the other half payment 30 days after the initial purchase.  If the credit card account has been declined or denied by the credit card company, the meal plan will be suspended until all monies due are paid.  Faculty/Staff meal plan participant agrees to pay total in accordance with agreement governing use of such credit card.  In the event of default of payment, Faculty/Staff meal plan participant agrees to pay reasonable attorney's fees, legal expenses and lawful collection costs in addition to all other sums due hereafter.

 

LIMITATION OF LIABILITY

Neither ARAMARK, its affiliates nor any of its or their respective officers or directors have any responsibility or liability for any expense, loss, cost, injury, damage, delay, travel cancellation, accident or any other matter or thing whatsoever (collectively, "Costs"), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to: (i) the E-commerce Program or your participation in the E-commerce Program; (ii) any failure, delay or decision by ARAMARK or its agents, partners or suppliers in administering the E-commerce Program or amending these Terms and Conditions; (iii) unauthorized use of your Faculty/Staff meal plan; (iv) any offer, representation, statement or claim about the E-commerce Program, any agent, partner or supplier or their products or services, made by an agent, partner, supplier or any other person; or (v) the purchase, redemption for or use of any goods or services of CampusDish E-commerce program providers, agents, partners or suppliers, including any Program awards, whether made available by ARAMARK, any of its affiliates, agents, partners, suppliers or otherwise. This applies even if ARAMARK or its representatives are advised of the possibility of such Costs.

NO WARRANTY

THE ARAMARK CampusDish E-COMMERCE PROGRAM AND ITS AGENTS PROVIDE ITS WEB SITE AND SERVICES "AS-IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. THE E-COMMERCE PROGRAM SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. ARAMARK does not represent or warrant that the information in its CampusDish website is accurate, complete or current.

TERMINATION, CHANGES AND BREACH
The ARAMARK CampusDish E-Commerce Program reserves the right, at its sole discretion, to suspend or terminate the E-commerce Program, to add, delete or change any E-commerce Program partners or suppliers, and to alter, limit, modify or add to the ARAMARK CampusDish E-Commerce Program rules, regulations, terms and conditions including, without limitation, the modification or update of these Terms and Conditions. ARAMARK may make these changes to any aspect of the E-commerce Program, all without prior notice at any time and from time to time. The most current version of these Terms and Conditions can be reviewed by clicking on the "Terms and Conditions" hypertext link located at the bottom of our homepage.

TRADEMARKS, TRADENAMES AND LOGOS COPYRIGHT
All names, logos and marks appearing in the CampusDish website are, except as otherwise noted, trademarks or service marks owned or licensed by ARAMARK or its affiliates in the United States of America. The use or misuse of these trademarks or service marks or any other content on the CampusDish website, except as expressly permitted in writing by ARAMARK, is strictly prohibited.
Any works of art reproduced on our website may not be reproduced in any medium for any purpose whatsoever. The copyright in the material contained in the CampusDish site belongs to and remains with ARAMARK. Your access to it does not imply a license to reproduce and/or distribute this information and you are not allowed to do so without our prior written consent

GENERAL
These Terms and Conditions may be different from what you know about the CampusDish E-commerce Program. These Terms and Conditions constitute the entire agreement between you and ARAMARK regarding your participation in the E-commerce Program, and your entitlement to any other benefits of the E-commerce Program, and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with ARAMARK over the Internet, you consent to the formation of contractual relations through electronic communications. ARAMARK is the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the E-commerce Program.
