Meal Membership Terms & Conditions Fall 2009 & Spring 2010 Semesters

This agreement is made between ARAMARK/Eagle Dining and the meal membership payer & recipient, who agree to the following:

1. Meal membership participants may upgrade a meal membership at any time.   Any additional money owed is due at the time of upgrade. Meal membership participants may downgrade a meal membership for any reason during the drop/add period (by 5:00pm on Friday, August 28, 2009 for the Fall Semester and by 5:00pm on Wednesday, January 13, 2010 for the Spring Semester). The difference in the remaining value of the membership will be transferred into your Dining Dollars account and not refunded.  

2. Cancellation Policy

Request for a meal membership cancellation must be accompanied by documentation from FGCU, as stated below, that you have withdrawn from the university. The amount of your refund is based on the date we receive the documentation noted below. The refund value for all meal memberships, including block memberships, is recalculated on a weekly basis throughout the semester. All cancellations are subject to a $50 cancellation fee.

a) If you officially withdraw from the university and you notify Aramark/Eagle Dining prior to the start of the academic semester (by 5:00pm Friday August 21, 2009 for the fall semester & by 5:00pm Wednesday January 6), your meal membership contract will be canceled and you are entitled to a full refund.

b) If you officially withdraw from the university after the start of the academic semester, or inform Aramark/Eagle Dining of your withdrawal after the academic semester has begun (after 5:00pm Friday August 21, 2009 for the fall semester & after 5:00pm Wednesday January 6), you are entitled to a refund of the remaining value of the membership, recalculated on a weekly basis with a $50 cancellation fee.

3. Meal Membership participants must submit payment in full at time of sign-up with a meal membership, unless participating in our EZ Pay Plan or Financial Aid Deferment. Important: All fees and payments must be made out to ARAMARK.

4. Any unpaid balances may subject meal membership participants to University Academic Hold status, which may prevent them from registering, receiving transcripts and/or graduating.

*A $25 administrative fee will be charged for any returned checks & declined or disputed credit card charges.

Meal Plan Provisions

1.  Your Eagle ID serves as a meal card and is required for all transactions — no exceptions.

2.  All traditional meal memberships are a two-semester contract (Fall and Spring). 

3.  Meal memberships are not transferable to others. “Block” Plan and “Any” Plan participants may bring in guests by using their meals (maximum 4 meals per meal period) or by using Dining Dollars. “Unlimited” Plan participants may only bring in guests by using Dining Dollars portion of membership.  Meal Membership participants must be present when bringing in a guest. If card holder is not present the ID card will be confiscated and turned over to the Eagle ID  Office.

4.  Unused Dining Dollars included with a meal membership or purchased in addition to the meal membership will expire at the end of the Spring 2010 semester on Friday April 30, 2010. Dining Dollars can be added to any meal membership in increments of $50. 

5.  “Unlimited” membership participants are not limited to a specific number of meals they can eat in one day; however may only use meals for themselves. “Block” and "Any" Membership participants may use up to 4 meals per meal period; i.e. breakfast, lunch, dinner, as long as it is within their limit of total meals for the semester.

6.  The meal week runs from breakfast on Monday morning to dinner on Sunday night.  Meals on the "Any" plans do not carry forward to the next week and end at the end of the semester.  Meals on the "Block" plans must be used within one semester. Unused meals from the fall semester do not carry forward to the spring semester. 

7.  Meals on the Block 150 and Block 100 must be used within one semester.  Unused meals from the Fall semester do not carry forward to the Spring semester.  Block members may have their card swiped up to four times per meal period.

8. Carry out is available and provided to you as a courtesy.  You must notify the cashier that you want your meal carried out at the time you enter the facility.  You may not take a seat in the facility once you have your carry out box.  No double portions on any one item.  The carry out box must be fully closed when you leave (no filling up the lid and base separately). If you desire unlimited seconds, you must dine in.  A maximum of two carry out boxes are allowed at a time, regardless of meal membership, and the purchase of two meals is required to carry out two boxes. If you wish to dine in and take home what you do not finish you must purchase the box separately as a meal.  Once you have your carry out box, you may not sit down in the restaurant again.  Failure to follow these rules will result in the forfeiture of your carry out privileges.

9.  Eagle Dining reserves the right to alter services or hours of operation. Notice will be given with modified schedules posted in all dining locations and online. Dining halls may be open prior to residence hall opening dates — entry during those times by cash, credit card and Eagle Dollars only. Fall 2009 meal memberships begin Friday, August 21, 2009 at 9:00am with breakfast at the Fresh Food Company and ends Friday, December 11, 2009 at 5:00pm with dinner at the Fresh Food Company. Dining Services will resume in the Spring 2010 Semester at 9:00am Wednesday January 6, 2010 with breakfast at the Fresh Food Company and continue until Friday, April 30, 2010 at 5:00pm with dinner at the Fresh Food Company.

10.  If your Eagle ID Card is lost or stolen, you must report it to the Eagle ID Card Office (239) 590-7654 _____________________________________________________________________________________

Holiday Breaks

·         Thanksgiving Break

    o   Fresh Food Company Closed November 24 - November 28 (Re-Opens November 29)

    o   All other food locations closed November 26 – November 30

·         Winter Break

    o   Fresh Food Company Closed December 12 – January 4 (Re-Opens January 5)

    o   All food locations closed December 25 – January 3

·         Spring Break

    o   Fresh Food Company Closed February 27 – March 6 (Re-Opens March 7)

    o   Einstein Bros Bagels & Subway Open over Spring Break

    o   All other food locations closed

On all other holidays where the University is CLOSED or there are no classes in session, The Fresh Food Company will be the only meal plan location open.
